The word itself\u00a0comes originally from the Latin &#8220;fides,&#8221; meaning faith, and\u00a0&#8220;fiducia&#8221;, meaning trust.<\/p>\n<p>A\u00a0fiduciary relationship encompasses the idea of faith and\u00a0confidence and is generally established only when the confidence\u00a0given by one person is actually accepted by the other person. \u00a0Mere respect for another individual&#8217;s judgment or general trust\u00a0in his or her character is ordinarily insufficient for the creation\u00a0of a fiduciary relationship. The duties of a fiduciary include\u00a0loyalty and reasonable care of the assets within custody.
